Agreement to Terms
These Terms of Service ("Terms") govern your use of Sinas's backend-as-a-service platform. By accessing or using our services, you agree to be bound by these Terms.
1. Definitions
- "Services" refers to Sinas's platform, including APIs, databases, storage, and related features
- "Customer Data" means data you store, process, or transmit using our Services
- "Account" means your Sinas account for accessing the Services
2. Account Registration
To use our Services, you must:
- Be at least 18 years old and capable of forming a binding contract
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
3. Acceptable Use
You agree not to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to our systems
- Use our Services for illegal or fraudulent activities
- Interfere with or disrupt our Services
- Resell or redistribute our Services without authorization
4. Customer Data
4.1 Ownership
You retain all rights to your Customer Data. We do not claim ownership of any data you upload or generate using our Services.
4.2 License to Process
You grant us a limited license to process Customer Data solely to provide the Services to you.
4.3 Responsibility
You are responsible for the legality, accuracy, and security of your Customer Data and ensuring you have all necessary rights to use it.
5. Service Availability
We strive to provide reliable services with:
- 99.9% uptime SLA for paid plans (99.99% for Enterprise)
- Scheduled maintenance windows with advance notice
- Regular backups and disaster recovery procedures
We are not liable for downtime due to circumstances beyond our reasonable control.
6. Pricing and Payment
6.1 Fees
Fees are based on your selected plan and usage. Prices are available at sinas.eu/pricing.
6.2 Payment Terms
- Monthly or annual billing in advance
- Payment due within 14 days of invoice
- Overages billed monthly in arrears
6.3 Late Payment
Late payments may result in service suspension after 30 days notice.
7. Intellectual Property
We retain all rights to our platform, technology, and documentation. Our services are licensed, not sold, to you.
8. Confidentiality
Both parties agree to protect confidential information disclosed during the term of this agreement.
9. Data Protection
We process personal data in accordance with GDPR and our Privacy Policy. We serve as a data processor for your Customer Data.
10. Warranties and Disclaimers
We provide our Services "as is" and disclaim all warranties except those that cannot be excluded by law. We do not warrant that the Services will be uninterrupted or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability shall not exceed the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
12. Indemnification
You agree to indemnify us against claims arising from your use of the Services, Customer Data, or violation of these Terms.
13. Term and Termination
13.1 Term
These Terms remain in effect while you use our Services.
13.2 Termination by You
You may terminate your account at any time. No refunds for prepaid fees.
13.3 Termination by Us
We may suspend or terminate your account for:
- Violation of these Terms
- Non-payment of fees
- Illegal or harmful activities
13.4 Effect of Termination
Upon termination, you must immediately cease using our Services. We will retain Customer Data for 30 days, after which it will be permanently deleted.
14. Governing Law
These Terms are governed by the laws of the Netherlands. Disputes shall be resolved in the courts of Amsterdam.
15. Changes to Terms
We may modify these Terms with 30 days notice. Continued use of Services constitutes acceptance of updated Terms.
